1Who these terms are between
These terms are an agreement between you and Ujwal Panday, an individual developer (“I”, “me”), for the Habit Garden app and any related content (“the app”). By downloading or using the app you agree to them. If you do not agree, please do not use the app.
2Apple’s standard licence agreement
The app is licensed to you under Apple’s standard Licensed Application End User License Agreement (the “Apple EULA”). That agreement covers the licence itself, including that the licence is personal and non-transferable, that Apple is not responsible for the app or its support, and that Apple is a third-party beneficiary of these terms. These Terms of Service add the details specific to Habit Garden (Pro, purchases, your data, acceptable use). If the two conflict about the licence itself, the Apple EULA wins.
3The app and your licence
I grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Apple devices that you own or control, for your own personal use, as permitted by the Apple Media Services Terms and the App Store usage rules.
You must not copy, modify, reverse engineer or extract the source code of the app (except where the law allows it), remove the app’s notices, resell or rent the app, or use it to break the law or harm others.
4Free version and Habit Garden Pro
The app can be used for free with limits (for example, a limited number of active habits, a limited number of reminders per habit, and a set of free gardens). Habit Garden Pro unlocks more, such as additional habits and reminders, premium gardens, insights, backup and restore, restoring archived habits, and removing the share-card watermark. What is included in free and in Pro may change over time, and the paywall in the app shows what is included at the time you buy.
5Subscriptions and purchases
Pro may be offered as an auto-renewing subscription (for example weekly or annual) or as a one-time lifetime purchase. The exact options, prices and billing periods are shown in the app before you buy, and prices can differ by country and currency.
- Payment: payment is charged to your Apple ID account when you confirm the purchase.
- Auto-renewal: a subscription renews automatically for the same length and at the current price, unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling: go to your device’s Settings > your name > Subscriptions, or the App Store account page. Deleting the app does not cancel a subscription. Cancelling stops future renewals; you keep Pro until the end of the period you already paid for.
- Price changes: if the price of a subscription changes, Apple will tell you and, where required, ask for your consent before you are charged the new price.
- Lifetime purchase: a one-time payment that unlocks Pro for as long as the app and the Pro feature are offered. It does not renew.
- Restore purchases: use “Restore” on the paywall to unlock Pro again on a new device or after a reinstall, signed in with the same Apple ID.
6Free trials
Where a free trial is offered, its length is shown before you subscribe. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription at the price shown. Any unused part of a free trial is forfeited when you buy a subscription.
7Refunds
All payments are processed by Apple, so Apple decides refunds. To ask for one, use reportaproblem.apple.com or contact Apple Support. I cannot issue refunds directly, but if you contact me I will gladly help you with the process.
8Your data and backups
The habits and logs you create are yours. They are stored on your device (see the Privacy Policy). I do not hold a copy, which means I cannot recover them if you delete the app, lose your device, or your device is reset. You are responsible for keeping backups you care about. The backup feature exports an unencrypted file, so keep it somewhere you trust.
9Reminders, widgets and reliability
Reminders and widgets depend on your device and its settings (notification permission, battery and focus modes, background limits). I try to make them reliable, but I cannot guarantee that a notification will always arrive on time or that a widget will always be up to date. Please do not rely on the app for anything where a missed reminder could cause harm.
10Not medical or professional advice
Habit Garden is a personal tracking tool. Nothing in it is medical, psychological, financial or other professional advice. If you are using it for a health goal, please talk to a qualified professional.
11Acceptable use
You agree not to misuse the app, including trying to interfere with its operation or with the purchase system, to bypass Pro limits, or to use the app, or images made with it, in a way that is unlawful or infringes anyone’s rights.
12Ownership
The app, including its code, artwork, gardens, flowers, animations, icons, text and design, belongs to me or my licensors and is protected by copyright and other laws. Your licence in section 3 does not transfer any ownership to you. Images you create with the share-card feature are yours to share, and the watermark (where shown) may not be removed by means other than the Pro option.
13Feedback
If you send me ideas or feedback, I may use them to improve the app without owing you anything, but I will not use your personal information for anything other than replying to you.
14Disclaimers
The app is provided “as is” and “as available”. To the fullest extent the law allows, I do not promise that it will be error-free, uninterrupted or suitable for a particular purpose, and I disclaim all other warranties. Nothing in these terms limits any rights you have by law that cannot be limited, including consumer rights in your country.
15Limitation of liability
To the fullest extent the law allows, I am not liable for indirect, incidental or consequential losses, or for lost data, lost profits or lost goodwill arising from your use of the app. My total liability to you for any claim relating to the app is limited to the amount you paid for it in the 12 months before the claim. None of this excludes liability that cannot be excluded by law.
16Changes and ending
I may update the app and these terms from time to time. If I change the terms in a way that matters, I will update the date above and, where appropriate, tell you in the app. Continuing to use the app after a change means you accept it. You can stop using the app at any time by deleting it (and cancelling any subscription). I may suspend or end access if you seriously breach these terms.
17Governing law
These terms are governed by the laws of the country where I am established. If you are a consumer, you also keep the mandatory consumer protection rights of the country where you live, and any dispute can be brought in the courts that have jurisdiction there. Apple’s own terms (including the Apple EULA) have their own governing-law provisions.
